Is it illegal to hitch-hike on the highway, or hitch-hike in a town? Or is it illegal at all to hitch-hike anywhere? B/c it would be very helpful to know...please don't say how dangerous it is just the legal aspects.

Thank you.

It is illegal to hitchhike on the interstate hwy. Most states have a no hitchhiking law as do most towns, however, except for extremely busy hwys, it is seldom enforced.
Usually the officer will speak to them, check them for warrants, and offer to transport them to a shelter.
Unless it is illegal to walk down the roadway (such as an interstate) it is difficult to prove they were actually hitchhiking so most officers don't fool with it.

This depends entirely on the state for the towns or state highways. On most of them it is illegal. As far as federal highways, it is never legal to hitch-hike on them.

I know it is illegal on a highway as are bicycles. That is why you see the hitch hikers near the entrance ramps only. I can't answer about back roads or towns, but I don't think it is illegal in those places.

Using California traffic law as a reference, it's a one sentence statute that says:

"No person shall stand in a roadway for the purpose of soliciting a ride from any driver."

That essentially means that hitchiking is not an illegal act in itself, but it's just not legal to stand out in the roadway while trying to seek a ride in that manner. If you stood on the sidewalk with your thumb out in search of a ride, then your act would not fit within the meaning of the statute.

Freeways are off limits to pedestrians, no matter what they're doing.

That's California though. You can look up your State law either on line, or by visiting the reference section of your local library and pulling out the vehicle code. Look up "hitchiking" in the index.

I think it is technically illegal. And if a cop is really bored or overzealous, he'll pull over and have a little fun. Personally, I have never hitch-hiked and have never picked one up.

it is illegal on the interstates at all hours, some places make it illegal to hitch after dark, other than that, unless it is posted it is legal.

The federal law on the highway system is that no vehicle or person without the ability to travel at 45 mph is allowed on the road at any time.

I've heard that it's illegal to hitchhike on the interstate, but haven't heard about anywhere else....

There's been times my hubby and I've seen a broken-down car, then later seen a person walking... offered them a ride. They didn't have their thumb out or anything, just walking.... hope that's legal!

It is illegal on limited access highways such as interstates. Other than that it is legal except for some localities.
