Jaffa Cakes are classed as cakes for the purposes of taxation, but due to their size and high number per packaging, shops generally stock them within the biscuit section. The name is derived from Jaffa oranges.

There was a court case about this very thing for the reason stated above.

It's a cake. Biscuits have VAT charged on them but cake does not. The government tried to charge VAT on it, saying it was a biscuit. There was a bit of 'oh yes it is,' 'oh no it isn't' for a while, and then McVities made a really big Jaffa cake, and lo, it was a cake. Biscuits go soft when they go bad, and cakes go hard.

cake i think. my boyfriend reckons biscuits go soft when left out and cakes go hard. jaffa cakes go hard. is that true about the vat on biscuits? i'm quite gullible.

This cropped up on QI. The difference is that biscuits go soft and cakes go hard when they stale. So they are cakes.

Since it says "cake" in the name, I would have to say that its a mini cake.

I wish I could eat them more often! I only get them when we visit my Nanna in England. I've only seen them here in Canada a few times....
