My visa is about to run out and I have applied for extension but answer may not come in time. If I stay and am late returning, what will happen to me? Another part, when I go home will I have trouble coming back on new visa?

I am confusfed. If I stay it is okay to wait or what? Who do I call for a answer that keep me out of trouble. Help

I agree with Hans B.
If you have applied for the extension, you would have a record that you are applying for one..you have to inform the immigration where you send the application that you are waiting for the visa extension if you have worries and they would tell you what to do or call direct to your nearest Embassy where you are regarding your status and you would have peace in mind. which you do not mentioned.where you are a citizen... they would let you stay if your application is on process...No, you won't have trouble if you have valid visa coming back unless you violate some immigration laws...

Your individual circumstances may vary, but in general, you describe a gray area - on the one hand, if you stay after you were supposed to have left, and your extension is refused, you will be flagged as an overstay. On the other hand, in terms of addressing length of overstay for future visa issuance, the clock does not really start until you have received the decision from DHS.

NOTE: The rules do not state that once you apply you have to remain in the country for the duration of the process until you receive an answer - they state that if you leave the country before you receive a decision, you will have abandoned your request for the extension - this is a big difference.

Also, bear in mind that while the Department of State is responsible for issuing visas, it is the Department of Homeland Security that allows admission into the US and monitors and enforces immigration status.

Before my wife and I got married, she was in the country on a tourist visa and when we met she applied for an extension. The rules state that once you apply you have to remain in the country for the duration of the process untill you receive an answer. Trust me, don't leave the country if you want the extension, but talk to the people at homeland security because if you overstay your visa you may never be allowed in again.

you are able to not no longer purely return to the US, your extension is now void. besides you does no longer even make on a airplane without the right visa in hand. Wait a mutually as and reapply later.

apply well before it expires and do contact DHS if you run afoul the next time will be very hard for any kind of visa
