how would we enter Pakistan without their express permission, and not enter into a war with them?

You have two completely different things confused:

(1) Acts of War, which are deliberate hostile acts by a nation's armed forces that violate the sovereignty of another nation (whether this is a simple border incursion or an airstrike); and

(2) A Declaration of War, which is a statement by a nation's government that makes a state of war between two nations (with the sundering of diplomatic ties) a political reality.

For (2) to come about, the War Powers Act would have to come into effect. For simple (1), any old military incident or push for direct action against Pakistani interests that Islamabad finds unacceptable will do. The American military isn't interested in pursuing military action against the Pakistani military; it's only trying to get to the Taliban fighters and other scumbags the Pakistanis are shielding. A de facto state of war would only exist if the Pakistani military decided to retaliate against American forces pursuing terrorists.

The Pakistanis may have questionable loyalties, but they are not completely stupid. At least, not demonstrably, yet.

By the way, the majority of answers previous to this one have demonstrated complete stupidity beyond any doubt or hope of redemption. How you knuckleheads believe you are qualified to speak as authorities on sociopolitical matters is mind-numbing.

This is why we have not ordered our ground troops into Pakistan. Too bad because that is where the big name terrorists are hiding. Pakistan play both ends toward the middle. They are actually NOT our ally and never will be because they are a Muslim nation. The more I learn about the Muslims the more convinced I am that we are waging war with murderers and truly bad people. If Iran should ever get the bomb they would give it to the Jihadists piece by piece rather than in a lump sum. One tiny piece could blow up the Golden Gate Bridge in seconds. No more waterways. No more Statue of Liberty. No more tunnels and bridges across the USA. Dams broken, flooding fires and on and on. Count on it from those bastards because they all want to die and go to heaven as special warriors and be enclosed in a room with 72 virgins, all with ample bosoms.

Nah, it's not a decleration of war. An "I declare war on you" statement is. Entering w/out permission could be seen as an ACT of war, but all will depend on the circumstances.

I love canctu and the references to "pre-emptive ILLEGAL war".

I have no respect for someone who slings whatever mud they can, without backing it up. Next, they will say Bush is secretly poisoning little children in Somalia, because he's a "big evil zionist Jew" or something.

How is it illegal when the country we invaded fired on our planes, invaded other sovereign nations, butchered it's own people, violated countless treaties, and threatened the world with weapons of mass destruction (which was a lie, but he still did it.... not very peaceful to threaten everyone around him)?

I suppose it would have been illegal to invade Italy during World War II, because hey, they never attacked us. Those peace-loving Italian fasicsts... we had no right to kill their soldiers and force the surrender of their regime!

No, it isn't a declaration of war. Only Congress can go that.

It probably would not even be considered a hostile action, particularly if it occurs in the wilderness areas where bin Laden is hiding out, and only happened in an effort to root him out.

That would be called an "act of war" not a declaration of war. Only Congress can make a declartion of war. Pakistans government would have to make a declaration of war on their part.

No it isnt, and the US has a long history of military actions against countries not capable of reaching its homeland, so why declare war? Interesting though how the US can engage in military actions so freely. Separation of church and state I have heard of, but its more like separation of congress and war. Commander in chief of the armed forces... who realy needs a congress to declare war?

The US sought permission even to fly over the territory to send men and material to Afghanistan. That is the norm of civilised nations.

yes and declaration of handover of nukes to jihadi nutcases if armitage really wanted that to happen he should have gone ahead entering a soverign country without their consent mostly is an act of war
