Here's the delema. A couple, married in Texas; the wife leaves and goes to Florida. Enrolls their 2 children in school.... The father desperately wants his kids back. In Texas, a husband can not kidnap his kids, theirs nothing the cops can do... He's has thought about going to the school and getting them, but she probably put a note saying that he is not allowed to pick them up. This woman does not need these kids... trust me. She has already gotten her other children (from a previous man) taken away for child molestation. What should the father do? Should he go to the school and "kidnap" the kids? He doesnt want the mother to be involved much (she's a lunatic). Court process are long, and he fears that she will "disappear" and leave no trace next time. Should he alert the authories and get the kids from school with them there? He doesnt know where his kids are, the only thing he knows is the school they are enrolled in. Where can I find laws about this stuff, and what do you suggest?

Also Note: He has an attorney, and his attorney said to go get the kids and bring them back, then file for divorce. My question (it may have been unclear) was which method to use? just getting the kids from school? Locating their house (which might take a while)? etc

He needs to get his butt to Florida and get his kids back to TX, he doesnt need to go to school or moms house, no scene, get kids on way home from school or where they can just get in car and go. Leave! wait as long as possible to call mother, and lawyer should have a petition for divorce and emergency temp child custody filed. The mother doesnt have an established residence in tx so hell get custody for now I went thru this for 5 years, the Judge wont give them to her after she took them. go to Legal sites and read the custody stuff

He desperately needs an attorney. He may be able to get a temporary injunction for child custody - but he needs to act fast.
Any and all info on her, her criminal record, current living conditions, and any mental conditions will help but he needs to act fast.
Quite honestly, most laws are biased toward the mother. And, most judges are biased toward the mother. He will need an attorney to guide him through this process.
If he files for divorce, he can also stipulate that she can't leave the state - but, the longer he waits, the harder it will be.
