My 18 year old brother was taken by police to the psychiatric ward of a hospital late last night, for attacking our grandmother. He has a history of mental illness, is on meds, and also is moderately retarded, with an IQ of about 55 (don't think this means he can't hurt anyone - he is almost 300 pounds and gets pleasure out of the pain of others). He's been in the hospital for behavioral/anger problems numerous times (he's also been in residental schools). He is violent toward many different people, and my parents and I would fear our safety if we were to take him back home (at least right now, if he can't go back to a treatment center or long term psych hospital). The hospital has drugged him up temporarily and decided that someone needs to pick him up, that he's fine to come home (for now..). We at home all know they are wrong, they have not seen him at his worst - but they are "threatening" to just release him (even if we don't get him). He cannot be on his own - can they do this?

You might need a lawyers advice on this situation. Thats a toughy. Thats sad what hes living with and that the family is in fear at times. He may need to live in a place for ppl like himself. Maybe you can ask a doctor, they may know.

Yes they can, and in fact, holding a non-dangerous person against his will is the akin to incarceration. So they must release him. At the same time, he is an adult and you don't have to take him. He can live elsewhere under supervision. There are group homes.

Try to contact you developmental disabilities agency to see if they can help locate a more suitable home for him.

this happened with my brother almost the same way they said he was bi-polar.

ok they can and will release him. your mom or dad can get him admitted on their own... they will have to fill out forms ect. while they will admitt him but after they do u can get the state to pay for it by going down to the department of human res.. and there is a form for government assistants with mentally ill patients that the will have to fill out..... what my arents did was press charges against him the next time they admitted him while the forms were being proceesed and then after which he spent 3 years in the hospital and came out a whole new person..

unfortunalty yes if he convinces the hospital he will not hurt himself or anyone else the hospital can release him, just dont let him in the house he is 18 old enough to be on his own just go to the police and get a protection from abuse order and he cant come anywhere near the house or your family if he gets caught he will go to jail

In most states a person can be held for 72 hours. Then if the psychiatrist determines that the person is a danger to him/herself or others you go to court. Then the judge determines what should happen next. Express your concerns to the doctor. He should be able to advise you on what to do. I believe you can have him involuntarily committed for a longer period if he's dangerous to himself or others.

After reading your question, I feel like what they ought to do is send the guy to another hospital that can take better care of him than they can there. Also, I was wondering....Have you ever considered putting him in a group home? That might be good for him.

sadly, yes they can. they are only allowed to hold a person for 72 hours at the most against their wishes without a court order. I suggest you get a lawyer to get his police records and get a judge to sign him in to a hospital.

the doctor that prescribes his meds needs to be notified immediately, and a further evaluation needs to be addressed.....if your family fears for your safety, and your brother has a history of violence, (he attacked your grandmother!?!) please don't put your family in further jeopardy by simply allowing him to come back home now. the next time he gets violent it could end tragically. best of luck to you and your family, i'm sure this is a difficult situation for you.

YOur brother maybe in trouble!!Why would you want him out of hospital.He should be treated.And need's to get help.Maybe in a mental institute or Rehab.He shouldn't be realeased.Well they can unless your mum suggest's his problem's to them.He could prescribe drug's or go into a mental institute to help him get better.
