If someone smokes a lot of pot around their child, is that considerd child abuse. Can you get in trouble for that? Should it be reported? What would happen if it was? would the child be drug tested?

yes, that's child abuse. Noone under the influence of drugs can properly care for a child, not to mention the poor example it is setting. Yes, it should be reported...it's neglect. Probably, social services would become involved, make visits to the home, etc...social services here in the US never seems to take a kid out of a home in time...usually they are left there, and then you hear about them in the hospital, etc..but at least you have to try. And yes, they can drug test children...but I'm not sure how much would be in their blood stream being exposed to second hand smoke...

It could be considered abuse if there is neglect of the child in the process of the person using pot.
Yes, you can get in trouble for that.
It should be reported! If you are a teacher, health worker and do not report abuse you can lose your job.
The child would be come the property of the state until the parent could prove that they have cleaned up.
The child might not be drug tested, unless their is a reason by the district attorney to check for drugs.

I only ask that you really think about what is in the best interest of the child. If someone is smoking pot (and not heavy drugs) with no one else in the home to take care of the child, I would not report it. I have seen too many children taken away from their parents and thrown into the foster parent's homes where, unfortunately they are not wanted.........thereby creating much heartbreak on the child.....just be sure of your motives. If you don't have a pure and clean heart in this (ex. wanting to get the guy in trouble) you will carry this burden of retaliation for a long time to come. Personally, I have never smoked pot, but I know many good parents who do.....is it right? no....but worth turning in on this alone, the answer is a big NO. My pediatrician daughter insists that children need both parents for good and bad....not foster homes..

Sounds like more going on there than just smoking pot. Yes, I feel that smoking anything with a child in the room would be child abuse. The person in possession of the pot would be in trouble just for having it, much less smoking it with a child there. Think the test on the child, to prove that this was occurring, would simply be tested with a piece of their hair. To report it, you would have to have proof of it occurring, not just your word. It is a moral question on whether or not to report it.

They would be investigated. Often that is merely the tip of the iceberg in a family. Typically there is much more wrong than that when it happens. That would be up to the department of Children and Family Services to determine whether or not the environment is safe and stable for a little one.
Sorry, but typically they put the child in protective custody.

That child near person who smoke.smoke passive.So yo most report that person.And if that person smoke pot or some drug near that child, later that kid will smoke drugs later too, and maybe get into some trubles later.

u can get introuble just smoking pot period... and yes i think it should b reported... if they have a kid they shouldnt be doing that kinda stuff... they need to grow up. and im sure the child might b put into a foster home. and the child shouldnt b drug tested because if they were it would show that they have that in their system.. (im just guessing from experience im sry if i didnt get EVERYTHING right)

Not sure if its considered child abuse, but it is considered child endangerment. If caught child can be taken away and either given to a relative or to the state and put into foster care.
Should it be reported, of course.
