trying to find out what qualifies as child molestation, can a 22yr old male be prosecuted for molestation if the girl is 16 and willing however her parents are against it and trying to stop him but he refuses to gp away.

First off, most of these people don't really know the law, they are just giving you an answer based on their opinion of what the law is or what it should be. To people who do that: DON'T! If you don't know the law for certain, don't give legal advice. If you are wrong, you could really screw someone up and get them in real legal trouble.

To answer your question, the elements of child molestation (or sexual misconduct, sexual abuse, etc.) will depend on how the law is worded in the state code for wherever you are. If you tell me what state/country you are in, I can give you a better idea of what the specific law says. Some states consider kissing as sexual contact, some do not. It also depends on the "touching" and what part of the body it was. Another factor that comes into play would be the age of consent in your state/country. It can vary widely from one place to the next. Some places are as low as 12, others are as high as 18.

Whether the underage girl consents or not is not in issue. You are describing a situation that will most likely qualify as improper, but as to illegal...much still depends on the kind of touching and the kind of kissing. I suspect however, that if you were more specific, you'd be describing something that the older guy can get into significant trouble over.

Yes, he could be placed under arrest, even if she had agreed and the affection was mutual. I'm not sure if it would be child molestation, but it would be molestation of a minor. It's not rape until they actually have sex.

A 22 year old has nothing in common with a 16 year old. Why would he want to be with her anyway--oh yeah, sex.

Depends on the State you live in. Sound like great parents. Most civilized states say 17 the age of consent. A few backwoods states have it much lower. If the parents know about it they should be calling the damned police.

Yes, if one person involved in sexual activity is under the age of 17 (18 in some states) AND both actors are more than 2 years apart in age, it would be considered child molestation or statutory rape.

I don't know the laws where you live, but what is the 22 year old thinking?? He should have is nuts chopped. What kind of person over 21 wants to get involved with a 16 year old child???

Get on the internet. Type in rape laws + your state and find out what the law is. Age limits are different in each state. This can be possible sexual harassment or misconduct. Your parents may punish you and ban you from seeing him, but those are their rights and decisions as parents. Don't forget that under 18, you are still a minor.

PLEASE, PLEASE, PLEASE use protection if you're having sex! I strongly believe in the right of choice, regardless of your age. If you're having sex, get some condoms and head to your local Planned Parenthood for birth control. They will give you free condoms too. You won't regret it!

Oh God yes and thank goodness for that law.
The girl is out of control and the prevert needs to be castrated. There is no such a thing as consenting to a 22 yr old when your not mentally mature.!!!!!!!!

She is not eighteen therefore they can get some kind of offense against him, I am not quite sure I know if they have sex the parents can charge him with statutory rape even if she is willing.

I don't know about molestation, but it's definitely a "beatdown from daddy" type situation.
