It also depends on the "touching" and what part of the body it was. Another factor that comes into play would be the age of consent in your state/country. It can vary widely from one place to the next. Some places are as low as 12, others are as high as 18.

Whether the underage girl consents or not is not in issue. You are describing a situation that will most likely qualify as improper, but as to illegal...much still depends on the kind of touching and the kind of kissing. I suspect however, that if you were more specific, you'd be describing something that the older guy can get into significant trouble over.

Yes, he could be placed under arrest, even if she had agreed and the affection was mutual. I'm not sure if it would be child molestation, but it would be molestation of a minor. It's not rape until they actually have sex.
A 22 year old has nothing in common with a 16 year old. Why would he want to be with her anyway--oh yeah, sex.

Depends on the State you live in. Sound like great parents. Most civilized states say 17 the age of consent. A few backwoods states have it much lower. If the parents know about it they should be calling the damned police.

Yes, if one person involved in sexual activity is under the age of 17 (18 in some states) AND both actors are more than 2 years apart in age, it would be considered child molestation or statutory rape.

Get on the internet. Type in rape laws + your state and find out what the law is. Age limits are different in each state. This can be possible sexual harassment or misconduct. Your parents may punish you and ban you from seeing him, but those are their rights and decisions as parents. Don't forget that under 18, you are still a minor.
PLEASE, PLEASE, PLEASE use protection if you're having sex! I strongly believe in the right of choice, regardless of your age. If you're having sex, get some condoms and head to your local Planned Parenthood for birth control. They will give you free condoms too. You won't regret it!

She is not eighteen therefore they can get some kind of offense against him, I am not quite sure I know if they have sex the parents can charge him with statutory rape even if she is willing.
