I file separately and husband (of four years) told me that he had taken care of his taxes. Obviously he has not. How can I protect my assests?

curious george is correct as far as protecting your self from penalties for not filing. You asked about protecting your assets. Any assets held jointly with your husband my be subject to collection efforts by the IRS. I recommend consulting an attorney. The cost of a consultation is probably less than losing whatever the IRS can take.

You may need to see a lawyer. Check the IRS web site - irs.com - to see if filing as an "injured spouse" will cover your situation in the future. Filing amended returns for all the years you have been married - amending to include injured spouse - may protect you from the past. If your have filed as 'Married filing separately since you were married, it won't be long before the IRS is on to him, as you include his social security number in your filing, and they eventually cross check for his return

Make sure your assets are in your name only, not owned jointly. The IRS can not force a sale on your home, nor seize it if your name is on the deed.

Consult an attorney for more details.
