What you are not taking into account is the next couple of verses down, which states that those who are born again (or from above) have the Spirit. John 3:5 and 3:6-8 are not mutually exclusive of each other. If you are born again (or from above), then you have the Spirit.
Here is the passage in context:
5. Jesus answered, "Truly, truly I tell you, unless a person is born of water and Spirit he cannot enter the kingdom of God.
6. What is born of the flesh is flesh, and what is born of the Spirit is spirit.
7. Don't be astonished that I said to you, 'All of you must be born from above.'
8. The wind blows where it wants to. You hear its sound, but you don't know where it comes from or where it is going. That's the way it is with everyone who is born of the Spirit."
The verses are all linked one to another.

No, because some of us do not fully understand what "being saved" means. I wish someday someone would be clear about what it means (without referencing the bible).

A lot of people, myself included, simply don't care because your worship of a nonexistent being doesn't affect us. Granted, we atheists often find the religious zealots to be weak minded sheeple, but such is life.

Obviously not. If they knew this, they wouldnt be such hypocrites, judging others against what their savior teaches....

Do you realise that there is no reason to take the heaven-hell fiction for real?
