IF they have been here legally and acquired a Social Security card in their OWN name. Yes. But the children must remain in the US to obtain the benefits.

Illegals are not the only people that get deported. Legal residents can be deported and could have worked 20 years here legally with a real SS#.
I am sure she can still find a way to get her SS benefits anything is possible if you go thru the right channels.
I doubt the children will get anything though since SS is a personal benefit, not a family one.

What amazes me is that people knowingly stay illegal in any country for 20 years ... 20 years ago, in 1986, there was an amnesty for illegals ... did she not benefit from that? Or did she come afterwards as an illegal to this country? Has she ever received any tax returns during her 20 years here?
A tax or immigration lawyer should be able to sort this one out ....

No ,if you were illegal and deported
No if you were legal and deported
If you were legal and left on your on(retired) I think you are entitled to it.
Bunt you are so abrasive that even when you have a valid point no one want to read it.Use your intellect for good and not just insults
Human rights has nothing to do with Social Security
ask any American that didn't have enough work credits?
Its about law,the US laws.

People here are giving such ignorant answers , it just amazes me! Anyone who has come to work legally to this country has a real SSN. If their visa expires(and most visas are non-renewable!), they still keep their SSN and continue paying taxes. But if they are deported, they have no chance of getting any benefits from the taxes they've paid. Still, deportation can be overruled and if not, people can come back in 10 years to continue the legal fight for basic human rights.

did she have a legal social security number? She was a criminal ya know, and I am not sure how an illegal can get their hands on their own social security number. So she may be lucky if she is only deported.

Was the person working legally? Because if so, even if deported, I think you would usually be entitled to benefits, one way or another. Check with the Social Security administration.

Nope. If you are deported, then you were never an american citizen, and in-eligible for social security benefits.

If you are illegal, I don't think so... because your SSN is invalid and you can't claim that because your name and SSN doesn't match. But if you are legal, you can have your Pension.
