Since it is legally dead to begin with and this some thing dead walking around is a suspcious charater.

Someone is only legally dead after a doctor confirmed the death. Without the paperwork you will be looking at some serious time if you add some lead in his body, don't risk it. And if that isn't enough, even if you manage to get the necessary paperwork together you still might get prosecuted for tampering with a dead body or something similar and even if you are not prosecuted, the relatives of the deceased might have a civil lawsuit case for causing "emotional distress". Remember, in civil lawsuits you don't really need a cause, only a lawyer and a sympathetic jury.

So forget it!

Whether he is dead or not if you shoot him you're gonna be accused of his murder
(how can you prove he was already dead?)
