My boyfriends has three boy from his first marrage. One of his son was removed form his mothrs home and placed in the custidy of his dad & I. Now hhs are saying that they want him to go back to his mom''s home. however he does not to and his other 2 brothers do not want to leave with her anymore. My boyfriend pays her $750 a month for child support therfore does not have money for a lawer.

He doesn't have to have an atty, he can present the case in court himself depending on the ages of the children, the court will interview them as well. They will probably mandate mediation and he will have to pay for half of it, but it will give the court another recommendation to go by. The court will also modify child support but its a seperate motion that has to be filed.

Truthfully the child needs to be of a certain age to determine where they will live, until they reach taht age it is the courts decision.

Unfortunately for your BF most courts side with the mother, because of old people being in charge of important things. They are biased toward the mother.

The best you can do is look up what the age is in your state that a child can pick who they want to live with, then file for custody.

If HHS took the kid away, there must have been a reason, only problem is that nothing in life is free.

I bet you will have may differnt answers on this but I will try.

First I am a single dad who 5 years ago took custody of my son. There are some groups that claim they will help but really you are on your own.

I basically had to form an alliance with her family members and mine. I convinced them it was best he was with me. Then I started a war with Child Protective services. I know this sounds bad but if you really want it, you have to be mean. I had all family members call and complain to CPS for many months. At first they thought I was a joke but after 6 months or so they started to realize I was serious. In my case the mother was evntually tested for drugs after so many complaints and she failed and thats when me and my court appointed attorney stepped in. Oh Yea, When CPS steps in to take custody you will be provided a court appointed attorney to fight for your rights. Since you already have one of your children it should be easy to take the other ones.

I did what was necessary to get my kid. He was in a very bad and dangerous situation. By the time I got done with CPS she looked very bad. You have to find a way for CPS to get involved. Some people say this is bad but, you got to do what you got to do. I lied if I had to. Once they started investigating I moved in to take temporary custody. This is not easy and it is a long road but when you have no money this is one way to do it. CPS will investigate and it is up to you to give them things to investigate. If your desperate enough like I was, you will find a way. I would let nothing stop me.

Now my son is 15, plays football, is good in school and is very happy.

you need to contact the courts. But most of the time, the mother does not have to give up custody. Its hard to say. You might want to try getting a free consultation with a lawyer. They normally give you the first visit free. Look in the phone book. Good luck

i'm sorry for you. I grew up w/o a mom, she died. i understand the absence of a parent. i'm additionally elevating a son, who's now 14, who's father isn't in his existence lots in any respect, perhaps one million time a year. although I on no account down talk him to my son. i do no longer want my son to strengthen up with hate. that's substantial to me. i do no longer want my son to hate because of the fact his father is a coward and has incorrect priorities. that's his new relatives. I tell my son that his father loves him, because of the fact he does, yet he would not understand the thank you to be a father. some men are cowards and can't face issues even no count if that's a failed marriage etc. i do no longer understand. It would not excuse it. yet your father continues to be alive and although he wasn't there for you, on no account meant that he on no account enjoyed you. attempt to no longer hate, your toddlers will experience that from you and that's a heavy burden to stroll around hating. Forgive and take it for what that's. you have a mom who grew to become into there for you, and you're a guy even w/o your father. you have stumbled on your own way and clearly are greater of a guy than he. So cherrish what you have and people who love you!!!!

The only way to get custody is to go to court and if his wife has an attorney he will need one too.

However you need to be really careful. Kids will tend to tell each parent something different to try to please them so its quite possible these same kids are telling their mother they want to live with her and not their dad. Until they are about 14, the courts will not talk directly to the children. It would probably be better for your boyfriend to try to work cooperatively with the children's mother to raise these kids together, than to spend endless years and money fighting over them in court.

THATS A tuff situation. IF the mother is not willing to send the boys to the father. THEN the only other answer is an attorney and courts.

see if there are any agencies that provide free legal help. also, some places have it where a child can choose where to live. age 11 or 12. check it out.
