ive been with my partner for 2 years and i have a daughter whos 3 next month. her real dad hasn't been bothered with her for ages and doesnt phone come round or anything,not even christmas and birthday cards and presents. can my partner adopt her with out permision from her real dad? we are due to get married and i want her to have his name. if so how do i go bout it!

Does your daughter have his surname. Was he there when her birth was registered. If yes then you deffinatelt need his permission- he will have equal parental rights to her as you do.

Ok as a Legal professional and a father in a broken relationship I feel i can asnwers this question correctly, the father if stated on the childs birth certificate must give permission for the adoption, as others have said he will prob do this unless he is selfish and wants to just cause problems, Fathers have similar rights to the mother, however the father can not obtain a passport for example unless married to the mother at time of birth. You may have read about fathers rights in the newspapers, fathers by law must pay for the upbringing of a child which any responsible dad would be eager to do, however he can not make certain disscions ie choice of doctor without the mothers permission, also the childs mothers mother has certain rights, these i am not 100% clear on, if in your situation i would try to approach the father, if he says no and does not currently pay for the childs upbringing then tell him that you are considering going to CSA, that should scare him enough, failing that seek formal legal advice and there may be a chance that you can prove he has no willing to be part of childs future, end of day a court would see the childs intrests at heart and rule accordingly however do you really want to go that far, one day your child will want to know why name etc is different

The only way he can adopt without him knowing is if the real fathers name is not on the birth certificate. Then its easy! But, I do know from experience. If he does not pay child support, has not seen her in a year or more, That its alot easier for a judge to help you out. But your daughters dad does Have to know and sign rights away of your daughter. So unless he's not on the birth certicicate, He HAS to know. But chances are, He'll sign the papers.

Yes it can be done if you can prove that the father has had no contact with you or the child in either 6 months or a year, and you don't know where he is, then the court considers it abandonment, I can't remember if its 6 months or a year though, You should check with family court but there is a time limit and then they consider it abandonment and then your partner can adopt the child.

ur partner cant adopt with out her fathers permision if hes on the birth certificate ... but if he isnt u can then go an change ur little 1's name by depole .. go to ur local cab ( citizans advice bereau) they r very helpful an will tell u eveything u need 2 no..... good luck... i just sent my eldest 2 skool an every thing else with my partners name an that woz ok ..she just has to go bk 2 wots on her birth certificate wen she decides 2 get married, but ur a long way off from that yet ..lol

I believe you cannot simply make this decision without the father's knowledge. No court would take the father's rights away like that. I suggest you consult a lawyer on the best way to go about this.

No you need his permission, if he's not bothered with your daughter then he shouldnt be a asshole and let you fiance adopt her, he should let him be proper dad not just a sperm donor, which is how it sounds like he is acting!

Ps my dad wanted to adopt me and my brother, although he never did, we still had his name, our mum just asked the school to change it.
