are you divorced or separated first of all if he left or kicked you out you can't get support unless he is out of the household. they go off of his income and yours you really need to call your local domestic relations office in your state you also my be in titled to spousal support since was was unfaithful. good luck...

You need to check with you local courts regarding this matter there they can assist you with your child support question. But I will tell you this, in the state of Michigan If a parent gives up his rights the only thing that means is he has know say so over the child welfare. If you wanted to take your child out of state he couldn't say nothing, if you got re-married and your new husband wanted to adopt he couldn't say anything because he gave up his rights. But He would still have to pay child support, because he doesn't care what happens to the child does not take away his support obligations to the child far as support.(food,clothes,healthcare) Now if you did get married and your new husband adopt the child, support can be his obligations. When it comes to annual income, they go by both parents annual income, and make the up the support price from there. and they will let both parents know what the parent who's out of the house will have to pay. It could be monthly, bi-weekly or weekly, it goes on how he gets paid. and both parents will have to maintain healthcare for the child.

This is a rule of thumb but not conctrete so you need to check with your state. Whether he gives up parental rights or not doesn't matter, if the girlfriend agrees or the child is adopted by another man then he is not liable, however if the mother is on state assistance then he could still be held accountable.
the amount is caculated by his income and the mother of the childs income, usually if you go to the states website there is a formula caculator for this, they do not count second jobs in the amount or the current wifes income(under most circumstances), with any back due amounts or old medical bills etc., they cannot take more than 50% off income most places are about 500 per month per child if both parents are making between 40- 50,000
if you are asking this question for yourself why woudl you stay with someone who cheats on you

Well he would not have to pay you Child Support unless you took him to court for it. Seeing as how what he did I suggest that you take him to court for this act he deserves to pay. Even if he is seeing or taking your children on weekends or so many days per month, you can still get child support. If you are worried that you will not be able to afford the Lawyer, you can request that either he can pay for the Lawyer or you can even split the cost. They are his children too and he should have to help support them even if he does have a new family. I am not sure how it will work with how much they will take from him. I do think though that since they are a family living in the same house that her income counts towards that. But every state is different your best bet would be to call a Lawyer and ask questions, that shouldnt cost you any money at all. Good luck.

Number 1. A parent is rarely allowed to give up their parental rights. He is the Father and most Judges will not allow him to just give up his rights. As to the child support the will take the mothers and fathers income and based on how much they both make they then decide what the child support should be. Look up your state laws online. Or call Support Enforcement. They should be able to answer any questions.

Actually, unless she gets married to someone willing to adopt the baby most states will not allow the father to give up his rights, and he will still be responsible for child support. Since he is married the courts may be able to use the wife's income as a basis for child support. This happended to a friend of mine when he remarried. His ex-wife took him back to court and he had to pay more because his new wife made a lot of money at her job.

he would not have to pay if he gave up parental rights, and no the wife;s income does not count. and as for the child support as a percent of the annual income im not sure.

it will depend on the state you live in. but here in alabama. it's usually 10% of the monthly income, and then divided into 4 weeks of payments. and that's court ordered. and if the father sign over his right, he may still be liable to pay support. and the wife's income, and the husbands income, are all one in the same. for example, say the husband is ordered to pay $500 a month, wouldn't that effect the wife as well? sure it's not coming out of her pocket, but that's $500, that would have been used in her, (there) household.

If he gave up his parental rights then he would not have to pay- but is that fair to the baby? And child support usually is a certain percentage of your paycheck- but I believe its different in every state. I would think it should only be his income and not his wife's.... I'm sure you can call the local child support agency and ask.

If he was able to give up his parental rights (not easy to do) he would not be responsible at all for the child.
Child support is based off of many calculations and percentages of the income. If he re-married his wife's income will be used.
