The only difference is the actual ceremony and license. Common law marriages (in the states that recognize them) are just like regular marriages and require a divorce to dissolve.

Common law is living together for a certain length of time and then without ceremony or anything poof you are man and wife; as long as both are single. Common law lacks backing for inheriting anything if one or the other should die. Marriage is binding before God, law and state. If you are married and one should die, then the other survivor easily transfers everything to their name. Common law means the kids need a last name (mom and dad are different names); marriage they automatically have a family name.

Not all states recognize common-law marriages..actually most states do not recognize it. It is when a man and a woman live together over a certain amount of time it becomes that they are married and the same laws etc. become effective.
Actual marriage is when you obtain a license and are married by someone recognized by the court that can legaly marry you.

Common-law marriage is when you are leagaly married by law, due to the fact that you live in the same household in a relationship with someone for the time that the State sets.
Actual marriage is when you go and get married.
The rules are the same etc.
