Orange cones flew into the road. The cone crossed 4 lanes. We were going about 55 and quickly came to a stop we hit the cone but also got hit from the car that was behind us. The caltrans work got the cone before the police got a chance to invesagate and the cone part was taken out of the report... There wouldn't have been an accident if the bottom of the cone was attached and wasn't flying into the freeway... What should I do can I sue the caltrans of las vegas?????

We did hit the damn cone!!!! And the person behind us wasnt paying attention cause we were slowing down the hole time we were watching the cone cross the lanes. and if there wasn't a damn desiel on the side of us i think thing would have ran a little bit smoother...

the road crew is not at fault. sorry... that is why you are supposed to slow down for construction.

no, you are supposed to slow down for construction crews. this is what the nevada dmv handbook says:

"Whenever you see orange signs, slow down, watch for equipment
and people working on the road.
• Be aware of flaggers working to direct traffic and follow their
instructions for everyone’s safety.
• Merge carefully and cooperatively."

that is why you need to be a defensive driver and avoid collisions. you could have hit the cone, avoided the car behind you, and it would have been stuck in your wheel well for the police when they arrived. you don't need to evade everything... and you should definitely think twice before slamming on your brakes on the freeway.

No winners here my dear. When you suddenly stop, slam on the brakes, trouble is always the result. In this situation I would have just hit the damn cone, then pulled over if necessary to remove It If It was trapped beneath my vehicle.
When Caltrans performs road work, there are always signs indicating this before you enter the work zone, along with a very
SPECIFIC SPEED LIMIT SIGN.
As this cone became loose and crossed 4 lanes is of no consequence. In the eyes of the law, YOU hit the brakes, the person behind you was following to close for the speed involved, and as a result, you are the one that caused the accident.
Yeah, It sucks...
Next time just hit the cone.. It's not a person or an animal..
If you were talking on the phone, I have no sympathy for you.
Forget about suing anyone.. It won't work.

Slow down for orange cones. It means that construction or something of the like is going on.

The person who hit you from behind is at fault. Not you for slowing down.

ummm....caltrans stands for California Department of Transportation, last I looked Las Vegas was in Nevada. You might want to try NDOT

How much damade was done to your car? If not significant, it will be a lot of troble. Also, whenyou sue a govenment agency, you have a limited time to bring the claim. Ask yourself, will you find a Las Vegas attoreney who will find it worthwhile to take your case.
