my sister hasn't been paying her credit cards, they call ALL the time and she's ignoring them, (not the brightest bulb) she'll be starting a job soon, can they take the money out of her checking account? i personally think they should if they can

This is not true. Credit Card companies, and collection agencies, can not take any assets from you outside of garnishing your wages. They can't go after any assets unless you put those up as securities for the debt. (Your house is a security of your mortgage loan.)

Tell your sister to inform the credit card company to not call her any longer and they wont be able to. If they do after she says not to, have her write them a certified letter stating to stop calling. If they continue, she can sue them for breaking the FCRA and FDCPA (Fair Debt Collection Practices Act).

no. even though she's delinquent and past due, they cannot take money from her without her consent. which is why they always always call for payments. if they could, they would take your money in a heartbeat without any thought of you at all. they need explicit permission to take money from your account or a written agreement like an autodraft agreement in order to do so. garnishing wages is only for legal proceedings if the case turns sour for her.

yes they can seize your bank account or your pay check unless u make an agreement with them monthly. the irs F u ck ed me.

Not quickly or easily. They would have to sue her to be able to garnish her wages or have access to any of her assets.

no, it will go to collections and if collections pursues it, they may be able to garnish her wages (which would happen before its even in her checking account)

if she just offers them something however small they will be forced to accept and get off her back.
