I got pulled up on by the police and they said I was driving too fast. The weird thing is, at the very very end when he was handing me the ticket he said. Im citing you for a stop sign, do you understand. I said "NO, I Don't understand" because they never said anything about a stop sign the WHOLE time till the very very end. It didn't make any sense to me. So did they do something wrong or what because I told him I'll see him in court.

okay let me clarify, The ticket says I didnt stop at a stop sign AT ALL 2 blocks away from where I got pulled over, before I even went fast, The cop car was probably out of sight cause he couldnt keep up with me so he has no proof of me speeding, the cops never turned on their lights they just showed up when I was in front of my house pointing their side light in my face as I was parking. Then proceeded to do an illegal search on me pulling soft object and EVERYTHING out of my pocket. Not just Hard things that COULD be weapons. THE REAL REASON they pulled me over was cuz I turned into my street fast causing some tires to screech. BTW the guy citing me was a ROOKIE.

oh and I would rather get the speed ticket I could not have been going more than 10mhp above it was like 25 feet of acceleration and 1 turn after that then thats IT.

For MIKE who said "Just be happy and pay the damn ticket." You know what this is the second time a stupid cop gave me a ticket for a stop sign I really stopped on, so I can honestly say I've been there done that! I'm tired of this bullshit and everyone elses bullshit responses. Maybe you would sit there and take it but I do not like being jerked around, and intend to fight back.
I forgot to mention he was under the assumption I had crack or something. Searched my whole damn car(no implied consent given). Took over an hour for the whole thing and embarrassed me in front of the neighborhood for a stupid stop sign ticket.

i remember something about being detained too long for the conviction? He was sitting there in his car doing his homework on police codes... Part of the reason it took over an hour. He continuously was asking his commanding officer or wutever what to do as well. He was some small asian guy who shouldn't be a cop totally unqualified for the job(mentally and physically). Basically I could kick his *** with one hand tied behind my back. (FYI I am asian too)

I was calm the whole time, like the way I always am most of the time. I gave them an attitude after the citation was given to me. Are you really gonna blame my attitude for this because an officer's peace cannot be disturbed alright stupid?
You have no basis to judge my whole character from this. I'm pissed cause I feel like an injustice was done unto me okay? I bet you'd feel the same way too.

The question is: Did you really run a stop sign? If so, were you driving too fast through it?
Does he have evidence? Remember, United States citizens are innocent until PROVEN guilty!
If you can convince the court that the you are innocent because the cop is knowingly doctoring testimony concerning you speeding/the stop sign, this should be enough to get the ticket dropped.
Unfortunately, the court has a tendency to believe a cop, maybe even over witnesses, so the fact that the court will believe you over the cop is questionable. Police are rarely punished for their misdeeds. Crooked cops are troublesome; quotas are even worse. The officer's quota of tickets for the month and when that quota is due could have played into the situation. He was probably out for tickets. Some officers expect that most people will not fight the ticket. They also believe they are invincible when hiding behind the protection of their badge.
If you truely believe you are innocent, yes, you did a good thing by telling the officer you will see him in court.
In this case, you should first consult a lawyer. Good Luck.

well if u had an attitude towards him such as u did here then no wonder u got a ticket! If you would be nice and respect them you will find it would have been better on ur part! Just b/c he wasnt behind u the whole time doesnt mean he didnt see you or clock u a little ways back!
I say go to court try to fight it and see what happens! oh yeah be nice in court..and u should respect these officers u dont see the crap they deal with on a daily basis.... Plus u should be happy he didnt get ya for speeding the ticket would have cost more!!! u should have thanked him!

My most recent speeding ticket (to tell the truth I have a driving record from hell), I got clocked doing 70 in a 55. He told me had I been doing no more than 10 mph he would not have even pulled me over and for some reason or other wrote my ticket for 60 in a 55 instead...probably something to do with the points or something, dunno. Sounds possible that is what he did for you...did you look at the fee schedule to determine which is the 'cheaper' of the two violations?
Okay...the chick who said that cop cars are equipped in such a way that the camera activates when the emergency lights are turned on...this is true, but not sure what that would prove since the so-called violation would have occurred prior to the lights being activated and so very often the officers aren't wearing their lapel mics for whatever reason.

I have to say that I agree with most of the responses (but not the stupid ones). The officer gave you a break. Look up the fine for speeding then check the fine for the stop sign. Guaranteed the stop sign is cheaper and won't raise your insurance rates. Just be happy and pay the damn ticket. You can thank the officer another day.

The fine for the stop sign violation is considerably less than the speeding fine. He cut you a very big break. Don't listen to the loudmouth broad who answered your question first. It's been my experience those who usually slam cops have had frequent contact if not on a daily basis with them. That no doubt explains her juvenile and baseless remark. Besides..."we" make sport of those people. She obviously was some police department's full time project.

be careful....... read the ticket closely... he might have done you a favor.... what did he cite you for? If it's for a speeding ticket, you could have to pay a hefty fine, get points on your license and your insurance might go up... If he cited you for "failure to obey traffic control devices" that's a no points, won't stay on your record, less hefty fine.... you WANT the "failure to...." one. Now, police are given a certain ammount of discretion to use.... were you speeding? did you not stop or coast through a stop sign? you never claimed your innocence in your question, so perhaps you're just looking for a way to get out of paying for your mistake... if that's the case, then stop whining, pay your fine and own up to the fact that that officer was doing his job and you got caught breaking the law.

Im a District Court Clerk and more than likely he gave you a ticket for Not Stopping at a Stop Sign because it cost so much less. You can try to fight it in court but you should be grateful he didn't give you a ticket for speeding. :)

Like stated earlier he is giving you a break. A moving violation such as speeding carries a much more severe fine and points than running a stop sign. My advice, pay your what $75 fine and appreciate the fact that you had a nice officer.

Find out if there was a video of the stop. In many locations, these are in cop cars and automatically start tape when the emergency equipment (blue light) goes on.
He can stop you for speeding or for running a stop sign. What did he ticket you for? He can stop you for both. Did he ticket you for both?
