Okay here is the deal- my mom being as absent minded as she can possibly be is supposed to begin a new job tomorrow. Not realizing that 2 weeks ago she recieved a notice to appear for jury duty( which also is for tomorrow). Now she happened to find the paper for jury duty today and calls me freking out, because it took a while for her to find this job. She tried calling, but they were closed already. If she misses jury duty it is contempt of court and she can face jail time, but if she does not start this job she will not have rent. what are her options?

I was in the same situation as her; I was starting a new job. When I got my notice I called the court; Could I get an extension? or a change? or excused? Nope. . .Nope. . .Nope.

Finally I wrote on the outside of the notice "Return to Sender, moved left no forwarding address." resealed the envelope and dropped it in the mailbox.

I haven't heard from them going on seventeen years!

Have your Mother contact the jury foreman, or the court house. There should be a phone number on her request for jury duty. If not, contact the courthouse and have them transfer her call to the proper department. All she need do is explain her situation, and ask for dismissal from jury duty. You would be surprised, how many people that are sent jury duty notices, just throw them in the trash. No one is going to come after her. She just needs to call and be honest explaining she is unable to serve on jury duty at this time, due to starting a new job, which would affect her finances. They may ask her again at a later date.

I got a notice once to appear for jury duty in federal court. In fact that time I was supposed to be on jury duty on one side of town, and in state court on the other side, at the same time! I took the notice and threw it in the trash. I'm not advocating you do that, or your Mother, but I would rather pay a fine than go sit and listen to all that crap for days on end. And I don't give a damn about what all the p.c. buttheads out there have to say about my civic responsibilities. I, for one, could not care less what my so-called responsibilities are.

Tell your Mother not to worry about it. If they try to fine her tell her to get a lawyer.

She needs to call and leave a message at her new job. She can't just not go to the jury selection and get a note from her new boss. Jury duty doesn't work like that, and she'll still be fined. She can call the court in the morning and beg to get out, you usually have one time to get out of going to jury duty without penalty

she just need to go to work and get something in writing saying that she started work on that date and then take it down to the clerk office,no big deal
