they shouldn't be fined or jailed until they know their car has/will fail an emission test and choose to do nothing about it.

Many times, persons who fail the emissions test don't know that there was a problem. I personally don't think they should be fined for this at all, especially not jailed. Now, if they've been given a certain amount of time to make their vehicle in compliance and haven't done so, there should be a fine or else no one is going to do it! Now, there are certain cases where people cannot afford to fix their cars, and in that case the DMV should work with them and give them a longer period of time so they may buy a working and passing vehicle or to gather the money to get it fixed. Now, I live in a county where emissions is not required, but I'm not about to take my catalytic converter off my vehicle because of it. I respect the atmosphere, but don't believe people should be considered criminals if their vehicles don't pass.

Should you be thrown in jail for farting???? Thats defintly polution, hey while we are at it lets get all these people that are using aresol cans and throw them in jail, OHHH we really have to get all the campers that are starting bon-fires. Dont forget about people in the country that burn their trash, oh wait lets just send a deisel garbage trunk 50 miles out for one house so they dont have to burn the trash, yea right only if its comin out of your pocket cause Im not wasting my tax dollars on that sht
Come on now the purpose of the emission's test is to let people know that their cars arnt runnin clean and that they need to get it fixed, if they dont then they just cant drive the car. why would you throw them in jail or fine them, then they lose their job or cant afford to get the car fixed because they were in jail or paying fines. What sense does that make???? If your car dosnt pass you have 30 days to get it fixed and test again, if you dont, you just cant drive, if you did your good to go. Its that simple

Isn't that what tickets are for? I agree with you to a point. Nothing is worse than driving behind someone and sufficating from their fumes. But to throw them in jail might be a bit extreme.
