My exboyfriend lives in North Carolina and wants to take my daughter to North Carolina or Florida. He has a habit of calling at the last minute and demanding that I let him do so. I have not let him do so because I don't feel comfortable with this. I have tried to explain this. I have never told him that he couldn't see our daughter- even after he has pulled a "no show" on serveral occasion. I have even allowed him to take her overnight to his father's house in Charleston, SC. I am not trying to make things difficult for him. I am a little fearful that he may pull a disappearing act especially since we don't have any type of visitation agreement.

Get a visitation agreement worked out with the courts immediately. Things HAVE to be in writing. You can't bar your ex from taking your daughter on vacations, but there should be stipulations in place and sufficient notifications. My visitation agreement says my ex must notify me 30 days before taking my son out of state. This gives me time to plan my schedule accordingly and work out homework plans with his teachers. Trust me, there will be a lot less arguing if you two have a plan worked out beforehand. If you have a child support order, there may be a generic visitation rights statement in existence already.

Specify it in the custody order. GET A VISITATION AGREEMENT!! Get it all on paper and legal, that way if he does pull something like disappearing with his daughter, he can be locked up for kidnapping. Good luck!

Get a lawyer and straigten this out through the courts. It sucks to have the courts in your personal life but what's the alternative. PLUS since there is no agreement I believe he can take her out of state.

You need to go to family services and get a court ordered visatation schedule. You need to get custody agreement as well so that if he does pull a stunt you have ground to stand on...You need something in writing
