The lien release dept of the finance company who financed his purchase of this car originally says they are overnighting the title release to him tonight. So he'll have that in the morning and can get the title to me tomorrow afternoon. As long as I have a signed sales agreement and a reciept for the money paid, can I go ahead and by the car? It's really a good deal and I'm afraid if I don't go for it, I'll miss out on it.

If you give him your money the only thing you'll miss out on is your money. Until he has Title in hand the car does not belong to him. It belongs to the finance company. If you pay him and the finance company has not released the lien, then they can come after you and reposses the vehicle.

DO NOT under any circumstances give him any money until you get the title for the vehicle!

A sales agreement is only good if he owns the car. If he doesn't have the title he has sold you SOMEONE elses vehicle that he does not own, so the sales agreement is worthless.

Just don't do anything until you see the title. As long as the title is in his name or you have the sales agreement signed by the person who is actually on the title (such as a parent or whatever). Also get a carfax report so you know the car is in good shape.

He can wait another day. There are plenty of cars out there, and if he isn't the type of person that understands your concerns, then I would see that as a red flag now.
Go on line with the VIN # if you have it and check it out for yourself. Look up VIN search.
it will give you the history on the car.
Tell him that you will give him the $$ when you have the title.
You can even make it sound like this:
Don't worry about me. I can wait until you get the title to take the car."
If you go against your intuition, then you only have yourself to blame if something goes wrong. Put the pressure on him to get you that piece of paper, not the other way around.

BTW - your payoff is purely the quantity final on your old settlement, which you had agreed to pay. enable's say you had $2500 final, yet you concept your payoff replaced into $1500. who's in charge for that $1000 distinction? you're - no longer the broking. in the event that they only made $800 on the vehicle they bought you, they could lose $2 hundred on the deal by eating YOUR payoff. As to advertising your old vehicle without the call - sellers do this continuously. considering you probably did no longer have the call, you signed a potential of lawyer permitting the broking to sign the call whilst the finance business enterprise releases it (as quickly as they pay off your old loan). The broking, even inspite of the incontrovertible fact that they do no longer carry call, has criminal impressive of possession on your old vehicle and might sell it earlier receiving call. Be very careful - you're actual the single that is close to to non-fulfillment of contractual criminal duty (study: lawsuit).
