It depends, if your fishing in your neighbors pool, it probably is.
Shotguns aren't very good choice because they scare away any fish in the area, and the pellets won't penetrate the water beyond 3 feet.

A conservation officer has more power than other law enforcement personnel -- he/she can cite you, arrest you, have your tackle confiscated, and maybe even your car.
