Yes we do it all the time. When they open the wine I mention that we may be taking some home and if we could keep the closure.
It is a very responsible thing to do to avoid just finishing the bottle and driving home. Bravo to you!

It does vary state to state.
Heck, here in Texas, up until about 15 or so years ago, you not only could have an open container in the car, you could BE DRINKING, as long as you passed the breathalyzer when pulled over. Not so anymore - no open containers.
So you never know - some states will allow things others won't. In Texas, you can't take a bottle out of a restaurant once it's opened.

When the meal is over, simply ask "can I take the rest of the wine home with me?" If so, they'll set you up. If there's any reason you cannot, they'll be more than happy to let you know why. It's the service industry...they'll bend over backwards for that tip, provided it's legal.
I've asked that same question at restaurants...it *is* legal in CA.

In most states, leaving a bar or restaurant with an open container (including re-corked wine bottles) is illegal.

A small conundrum. Ask for a "wino bag" and risk looking tacky (and possibly get in trouble with the law for having an open container of alcohol in your car), or drink too much and drive, or waste good wine. The laws may vary state to state. Call the restaurant ahead of time and ask.

In most countries in the world (except for perhaps our Muslim neighbors and a few weird states in the USA) you simply ask the server to recork your bottle and put it in a bag. If you are in an automobile place it in the trunk before driving.

It is not only not proper but also illegal. You can't leave a bar with your drink, and you can't leave a restaurant with your drink.
