It depends upon the state. As awful as it sounds, not all states recognize this as murder. CA does, which is why Scott Peterson was found guilty of two murders.
If the state doesn't recognize this as murder, they'll categorize it as an assault on the mother, of varying degrees. If she dies (which of course kills the fetus), it's only considered one murder.
As for your third question, I truly don't know.

If kicking can proven as the result of an unborn child to die then it will be considered as murder. Abortion is a crime and punishable by law in several states. The only way it could not be punished is when no one has proven it to be an abortion.

Wow the ignorance about the actual procedure of abortion is astounding......
Kicking a pregnant woman in the stomach is intent to cause harm to both the mother and unborn child and if the fetus dies then yes, it's murder.
Abortion is different because it is rarely done past the first 3 months of pregnancy unless it is medically necessary to save the life of the mother. Yes, it is a choice and dependent upon the mother to make it and only a fool would believe that people actually wait until just before birth to abort a child. That's just nonsense.
Pro-Choice does not mean pro-abortion it means pro-CHOICE....in other words.......the government needs to stay out of my personal medical decisions.

I have heard of people get in trouble for killing a womans unborn baby, but I am not sure if it was considered murder or not. If someone killed my unborn baby I would consider it murder. Abortion IS murder and I dont care that women say that it is their body or not.
You are not allowed to live off another person without their permission, and that is what unborn babies are doing, so I guess the US justifies abortion by that viewpoint.

I am not sure about U.S laws but it is definetely considered murder in Islam. Islam does not allow abortion either, it is considered murder too. (Except when someone is raped and gets pregnant, she can abort it if she does not want to carry the child of the rapist).

Here is some unbiased FACT:
Regarding the LEGALITY of both murder and abortion, legal matters vary from state to state and from jurisdiction to jurisdiction. I suppose you would have to research the laws in your local area. You can easily do this by looking it up the lawbooks at your local library.
Regarding the MORALITY of both murder and abortion, neither act is moral, and both acts are one in the same when it comes to what is scripturally written (KJV Bible):
Thou shall not kill.
There are no exceptions mentioned, therefore, no exceptions intended.

This is one of the laws that they haven't changed so far.. If you kill a pregnant woman, it is a double murder..

If someone kicked me in the stomach and killed my unborn child they may not go to prison but I sure as hell would because I would kill the ba**ard myself! and I don't understtand why abortion isn't illegal. It's still murder in my book and always will be.
