so if iwant to marry my fiance whilst on holiday in the usa this is fine and totally legal...as long as i dont outstay my time and return to England to apply for the relevant k-3 spousal visa is this correct?

staying in the usa, is not an option at all for me as i have my 6 yr old daughter waiting for me at home.....so am i doing wrong?? surely not if iam returning home and following the correct k-3 procedures?

Lets assume you are here on a tourist visa or visa waiver. If you marry him before you have been in the US 60 days, the presumption is that you committed immigration fraud by coming here on a nonimmigrant visa with the intent to immigrate here.

So at least wait to get married on day 61. Then instead of leaving the US, you and your husband (presuming he is a US citizen) file I-130, I-485, I-765 and I-131 to get you to stay and work in the US with out going through the hassle of the K-3.

This is not legal advice, just something that my friends had done.

Yes, you are correct. File for the I130 ASAP. It'll take 6-8 months for processing. The immigration process will test your patience and nerves! Good luck.

Yes u can but make sure that u get a Advance Parole Visa before returning to UK or they will not let u re-entry!
