My boyfriend's ex emigrated to Austrailia this summer as her new husband when he got a job there, she still expects him to pay maintenance for their 2 children but he's decided to save the money so he can visit his children next year & spend the money on them. He'd love to be able to pay but he can't pay & visit them next year.

She's now threatening legal action can she do this even though he's in the UK & she's in Austrailia.

I agree that maintenance should be paid & always was when the children lived in the UK but my question is more of a legal one than a moral question.

Just for the record I don't live with my boyfriend we both work full time & live within our means.

Yes he should pay money. It's his responsibility. If he wants to come see them he should get a 2nd job to pay for that expense. But, she should have consulted with him before the move and if she did he should have protested. He could have stopped it.

Of course he should pay his maintenance,

His kids still need support even if they are not in this country,

Why didn't he contest the emigration?

Maybe he can come to some sort of agreement with the mum on how he can finacially support the kids whilst saving to visit. x

its in the childrens best interest for the father to pay mainteance. I am sorry you cannot afford both but its better for the children to get regular money and letters or emails, then one visit a year

Maintenance? Child support? Yes, bring them into the world and they eat, drink, need a warm place to sleep etc. She didn't move, he did! Just because daddy moves, it doesn't mean the kids stop eating. "outta site ,outta mind" You obviously do not have children.

responsibility and all that!
And if he really wanted to see his children, he would find the money.
perhaps you could downsize your cars, don't eat out,only buy clothes if your others are worn out etc.

You and your partner should NOT be saying "do we have to"?

You SHOULD be saying "how can we make sure that we do!

I refer to you and your partner as one, seeing as you are a partnership, therefore you share an equal responsibility, his kids/your step kids!

he should pay maintenance
but let the courts decide , and bare in mind your earnings can affect the amount paid
