I rear-ended someone earlier today. We exchanged information but the other person said that they didnt think there was any damage done to their car. She said she would take her car to the dealership to see if there was in fact any damage, and would call if there was a report that needed to be filed, otherwise she said just dont worry about it. Can she come back and Sue since no report was filed?

yes she can attempt to sue , but the reality of the deal here is , she never called the cops , there was no police repot filed so what is she going to claim ?? she may get some insurance money without having to sue , if you were at fault then the insurance will take over the case , but if nothing were filed at the time of the collision it makes it a lot harder for her to caom back and say she is all messed up from the accident ........But if it is california then anything is possible, if she gets a real aggressive lawyer then he may try to sue regardless of the circumstances .......she seems like a normal person and I wouldnt worry, usually after an accident you can tell if the person is going to be a pain in your *** or not , if she was the sueing type she would have insisted on having the police there to make a report and tried to see to it that you were listed on that report as the negligent driver............I think you are ok on this one .........

The other person can go by themselves to the police station and file a report ithout you even being there. The police in major cities request that if the accident is not major or disabling to the vehicles involved that you drive to the station and make out a report.
Just because you didn't report it at the time does not mean that there is no report.

Without filing it on insurance and taking the necessary steps required to get the damage resolved I don't believe she'd have much luck.

I'm sure that there may be a legal loophole that would allow for a lawsuit but I wouldn't worry. She would probably have contacted your insurance company by now if she was even thinking about either fixing her car or potentially suing.

Nope. If there is no documentation of an accident, nothing really happened. You did the right thing. If you didn't give your info, she might have called the cops. Just wait and see what happens. Maybe call your insurance company and tell them what happened. They will be on your side, just tell them there was no report filed.

yes, same thing happened to me...an old man rear-ended me and also said there was no damage...a month later I got a ticket & forfiet of my license for 6 months for failing to report an accident and had to pay $1300 in damages.
p.s.
The person who rear-ends another car is "at fault" here in Wisconsin...unless it's not reported.

The best thing to do in order to protect yourself is to file a report with the police. That way, there is a record, and in no way can shew ever say you tried to hide the incident. I hope you got her plate # as well as her license and name and address. That would help too when you file a report.
