i was unknowinly caught by a handheld speeding gun, although i was following 2 other cars how can get out of the points on my license, they have sent no photograph etc and are claiming i was doing 85mph in a 70mph how come i was the only one who was targeted and not the other two cars of whom mustve been going faster than me?

First, hire an attorney.
Second, the disclosure process will require the manufacturer of the laser gun detector to provide information about the equipment which they may consider a trade secret. This forces the police to not be able ro satisfy disclosure and may result in no process.
Third, most states cannot legally charge you with speeding if you are only 5mph over the limit.
Fourth, seventy -five mph is still too fast for your reaction time if something goes wrong.

It never feels good to get a citation, especially when there are points involved. Some how the first reaction is always the same , at least I have found it to be, : the injustice of it all. That has happened to me a long time ago, of getting a citation for going through a red light. There were 3 other cars going through it after me, because the light could not be seen the tree limbs were covering the traffic light. Well I did pay the fine. And have gone through many a red light, not intentionally and have not been cited. Definitely slow down use the cruise control if you have one

Chances are you were spotted doing something in addition to the speeding...tailgating, crossing the lines on road or not using both hands on wheel. That is what may have prompted them to cite you and not the others.

If you know are are guilty many times (If you don't have a pattern of this offense) you can go to court and Plead Guilty with an Explanation. This way the officer will not be needed and the Judge / Magistrate will hear your case. You will most likely need to pay the fine but points are generally avoided (again as long as this is not a pattern for you).

You don't declare your state of residency so things may be somewhat different where you are. Here, in my state, you plead
"not guilty" and they will always reduce the ticket to usually a non-moving infraction. No community wants to spend tax payers money litigating a "speeding ticket"! And the police department will more than likely not be able to produce a recent "calibration" reciept for the gun!! I've done it many times and not only avoided points but kept my insurance in check also!
PS: don't waste your money on an attorney-you can do this yourself! Exactly what the attorney does without your knowledge!
Leave that "I was singled out" defense at home! The judges hear that everyday! You got caught so admit at least to yourself, you need to rectify your driving habits-even if only for safety reasons!

Yes, as MOM says, at least consult a lawyer -- this should be FREE if you go through the ATTORNEY REFERAL in your phone book (usually a 30minute consult).
DO NOT LIE & try to say it wasn't you -- they may have a photo and besides, I believe the law allows them to site the car's owner no matter who was driving !!!
SLOW DOWN -- all that's between you and a GRAVE is the little bit of rubber on your tires!!! At that speed neither you or your car can make corrections for mistakes quickly enough to AVOID TRAGEDY !!!!!!!! How would you feel if YOU KILLED A BABY in another car ????????????? Statistics show that you arrive NO SOONER at 85 than at 70 -- due to traffic in your path!
SEVEN YEARS AGO a guy couldn't wait a minute to get home -- he crashed into me doing 60mph, he destroyed my car and 4 other cars & his boat, but WORST OF ALL he DESTROYED MY LIFE FOREVER !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! I have to live in CONSTANT PAIN becuz he was in a big hurry -- he got home a lot later by the way !!!!!!!!!!!!!!!! He ruined my family's lives too -- I can't play with my kids the way I used to and it spoils their fun when we cant do stuff cuz I'M IN PAIN !!!!!!! And I feel such guilt for spoiling things for everyone all the time!!! I used to be so happy & fun loving and out going -- now I lay in bed most the day -- EVERY DAY -- IN AGONY !!!! It ruined my husband's life too, he now has to work for both of us --6 or 7 days a week: 12 -14 hrs a day !!! So, I ask again --- PLEASE SL O W D O W N !!!!!!!!!!!!!!!! P L E A S E !!!!!!!!!!!
btw, You can go to driving school, most states refrain from hitting you with points if you go, but PLEASE SLOW DOWN, I BEG YOU for everyone's sake!!!!!

Did they stop you? Or send you a citation in the mail? If they stopped you, did they show you the readout? If not, you can contest it. If they sent you a citation in the mail, how do you know they didn't cite the other drivers as well? If it's really important to you to avoid those points, I suggest you hire a lawyer to go to the hearing with you. At least consult one to see if there is any basis for contesting the ticket.

How do you know you are the only one?

Anyway, the only way is to deny that it was you driving, but just because they haven't sent a photograph doesn't mean they haven't got 1 so be careful. I think you are entitled to ask for a photo.

The camera catches one car at a time - the others may be in the same boat though, without your knowing it.
Sometimes you can avoid serious points by attending a safer driving clinic.

Take defensive driving to avoid points. This is one area where attorneys don't always do their job. You are taking a chance if you do hire an attorney.

Next time try following the speed limit instead of other drivers. I always set my cruise control exactly on the speed limit and never have to worry.
