A person can be asleep in the back seat of a car, if the keys are in the car (the car, not ignition) and you could get to them you can be arrested. Put the keys in the trunk, lock the doors, snuggle up and you are legal. Never drink and drive, never.

If you are talking about being charged with a DWI then here is how that works. If you have the ability to drive (ie: you are in the driver's seat with the keys in the ignition) yes you can. If you are sitting in the back seat and the keys are not in the ignition then you cannot be charged with DWI. You don't have to throw the keys away or lock them in the trunk or anything like that you can just put them in the glove compartment and sleep in the back seat and you'll be fine.

Do you mean driving while intoxicated? In most states, if you are in the car w/keys in the ignition and drunk you are going to jail for DWI or a similar charge. Just call a cab next time.

I know of a guy who had the keys cause he went to roll up the windows in his car (eletric windows) and got charged with a driving while suspended. I don't know the whole story, so I can't tell you why, he may have also had a warrent or something and that's why he got stopped, but anyways, I know his car got impounded (in front of his house) and he went to jail. my husband was the tow truck driver.

Cops pretty much do what they want most of the time, hide the keys well and make sure you don't have anything illegal on you.

if you mean charged with a dui, yeah. ur best bet is to not drink and drive or have the keys in your hand when behind the wheel and passed out. get a designated driver or call a taxi so they can drive you home. make sure your aren't to drunk to get out of the cab.

I'm not sure what it is you're asking. Are you talking about an intoxicated person? If so this is called a.p.c. or actual physical control. In other words being in actual physical control(parked) of a motor vehicle while intoxicated as opposed to driving under the influence.
