To be charged with what? DUI? You can be in your car with the keys in the ignition and get charged with public drunkenness so it makes no difference. My brother-in-law spent time in jail because he was drunk and sleeping in his car! That was in AZ...they don't mess around there with that garbage...and you shouldn't either. If you aren't at a safe place to stay...as the first person said...be a man...be responsible and don't get drunk!!

what state are you in? in texas if parked and drunk, move to passenger seat and put keys on floorboard on passenger side or in backseat. i think you can be in driver seat as long as keys are pretty much out of reach.
