We live together. We are not married yet. So how many dependents should he put down on his w2 at his new job. Does he consider himself as a dependant? Also how does the answer affect his taxes? Thank you very much.

legally he can only claim his self and any children he is supporting......when you marry and he is supporting you and you do not work or claim yourself then he can claim you......

Your boyfriend CANNOT claim you as a dependent on his Form W-4 because you are not his qualifying child or qualifying relative (see Table 5 to IRS publication 501, link below).

He may, claim either 0 or 1 exemptions on Form W-4. If he itemizes deductions, he can claim more (see link to Form W-4 below).

from what I understand, it depends on whether the state you live in recognizes common law marriage. In louisiana, where i live, it does not. Here, you have to be legally married to claim someone as a dependent.

Ask an attorney/check the laws where u live.

Tell him to put 2. They'll take a little more out of his check but he'll get any overage back as a refund.
