I'm pregnant and am going to file for court ordered child support. The father of my child is a complete *** and threatens to put everything he has (or doesn't have for that matter) under the business his mother owns. Now I thought as long as he had a job, they'd just take it out of his paycheck...I've looked up Illinois law and it's a little vague in the details. What can I do if he does put whatever under the name of the company his mother owns?? Can the Child Support be taken out of the company or am I just SOL if that does happen??

Also....does the law change or does it make a difference if I fight for full custody of the child. He says he doesn't want to see the child anyway, but if he changes his mind, and I want him to have very little visitation, does it make a difference on the child support?

THIS IS WHAT YOU DO (fa real i live in illinois) don't be ashamed go to public aid and tell you case worker all this tell them you need aid and THEY will get his *** for sure without a doubt you child suport will come to you thru them and THE ILLINOIS DEPARTMENT OF REVENUE GETS THEIR MONEY and if he has a judgment againt him for childsupport if he files his income taxes YOU will get you childsupport they will withhold his income tax chech and send it to you payable to you

I don't know what it's like in your state, but in California getting child support out of a man who is determined not to pay is a losing battle. Our system is overcrowded, backlogged and slow. My ex has owed me over 60,000 for about 6 years now and nothing is ever done. Yes, I finally get the monthly amount - about 30 days late each month, but nothing else is ever done for the arrears. He keeps quitting his job, moving, working under the table. He drives a better car than I do, has more disposable income and more money in the bank. He is single, lives in a tiny studio and has no other children so it's not like he has many other obligations.
It depends on how bad this guy wants to avoid you. If his family and friends are willing to hide assets and lie for him, that makes it even more difficult. He will bring people into court to lie for him, get ready to hear a parade of his family members and friends cry a river about how poor he is, how he was duped by you, and make slurs on your character, your sanity, your health, your lifestyle. Yes, the court will try to garnish his wages but it takes awhile and if he doesn't comply it takes awhile for them to get around to enforcing it, by then he may be gone. If you chose to be a single mom with a guy like this, be able to support the child yourself. That way any money you get is just a bonus. Never, ever DEPEND on that money to pay your rent or buy food or you'll be screwed.

A trick that some "men" use is to say they get paid on commission and in some states pay cannot be taken out of a check if the pay is on a commission basis. Another route for you to get paid would be to have it taken out of his income tax refund if he gets one. I would suggest that you get a lawyer who specializes in family law NOW or go to a legal aid group and request some assistance. Can I ask you something? If the "father " is such a complete *** then why did you have a baby with him? There are good men.

It doesnt matter. If he gets a paycheck it HAS to have his name on it. A simple DNA test through the courts will end all of this. Once its proven he is the father of the baby, then they will draw a child support order, no matter who's name he puts anything under! WHAT A JERK!!!!

First try to record any conversations you to have,some answering machines do this and bring all info that you may have about his job with you to court , he's not the fist loser parent that has tried to hide there income from the courts, so as much proof as you can get will help you receive more then the minimum wage rate that the attorney general will give you. good luck.

Make sure that you get full custody...as far as the money he makes he still has to file tax returns and that is what they base the payments on...so he can hide all the money he wants...he will be in huge trouble if he doesn't fiel tax returns.

If he is working for or part owner of company you are entitled to benefits. Once the court determines the baby is his child, they will award you your child support.
