Is it proper to use a handicap restroom stall when all others are taken and there are no handicap people using it? If you answer no then are you saying that because someone is handicapped they don't have to wait in line like everyone else?

it is not improper to use a handicapped restroom in the aforementioned situation. however, if you are in line with others and there IS a handicapped person, it is common courtesy to allow them to go if that is the stall that openes. you have 3-8 choices and they have one.

By law, in any public establishment there has to be one bathroom, whether it being a stall, or simply one main bathroom that is handicapped equipped. A person with a handicap can ONLY use this one stall - so should they wait in line - my answer is yes - for example - there is only one main bathroom (handicapped equipped of course) in a restaurant, bar or clothing store. There is a line up of let us say 4 women... of course the handicapped person should line up, but if we are talking etiquette, the proper thing to do is let this person go ahead of you. What if they are older or you have a mom with a young child (these folks may not be handicapped, but they definitely have different needs) - these folks cannot hold 'it' in as long as others. They must know they have to wait in line, but also hoping that a nice person with good etiquette will let them go ahead.

If I have to go and the only stall available is the handicapped one, darn right I will use it. The law says it must be there for the handicapped folks, but it does not say that a non-handicapped person cannot use it.

I do have to say, that when someone parks in a handicapped parking space and has no permit to do so - that pisses me off and they can get heavily fined and/or towed.. with good reason.

Yes, you are permitted to use that stall but a handicapped person has priority over someone else that's why it's designated handicapped. So if someone handicapped showed up while you were using it and there was a long line of non-handicapped the handicapped person would get to use it next, they would not have to go to the end of the line.

I think it's okay to use a handicap stall..I usually do because my daughter is still young and we need the extra room to move around in there together. If there is a handicapped person or a larger person in need of the stall we will let them go in and either we use a regular stall or we wait.

I have to use the handicapped bathroom and I have no problem if a non handicapped person is in there when I get there. I agree with you we can wait in line like everyone else.

Most handicapped persons having to use the railed stalls do have to an extent bladder issues. It is neither a matter of first come first served, applying the socialist cue system nor tax system. And if it were due to the tax system, all the more reason that the toilet was designated for the disabled.

Unless words such as consideration ( thinking of others, than the Me only syndrome ) and compassion are not in your dictionary, exercise due consideration and use the stall. Excuse yourself politely as you would to yourself if you find that you have accidentally inconvenience another.

I've used them when no other is available. I've never come out and saw a handicap person waiting.

Yes, use it. Otherwise it is being under-used. If a handicap person comes along, he will get in there soon enough unless you are in there baking a pie or taking a nap.

If there are no handicapped people around it is okay to use it. if there are, then let them use that one restroom first.

I think it is acceptable, Honestly, I rarely see handicapped people when I am in a public restroom, so I think it is absoutely fair to use.
