I would then become an illegal resident. My question now is : If my boyfriend (who is a US citizen) marry me, could i apply again to the INS as a wife of a U.S. citizen ? Would the Amnesty Law include cases like me ?

You need an immigration attorney answering your questions, not an opinion from the Yahoo immigration category.

NO! My husband & I have been married for over a year. We have an immigration attorney and here is how this goes down. Since you have no legal staus you have to go home and apply. It wouldnt hurt to talk to an imm. attorney yourself but do not get your hopes up!
We had some friends that went this route, he went back to his home country they waited 3 1/2 years. The invested over $7000.00 with INS & her going back & forth. They complied with every request INS had and he was denied for no reason at all.
Amnesty does not exist in America today.
Before 911 if you got married you could stay - many people think that the law still works that way. We have had people argue that with us because it was that way for a long time. However, that is NOT the reality of the situation today.

I believe you can apply again after you marry an American citizen. But the INS will watch you for 5 years - if you guys seperate or get a divorce, you are considered fair game again. Due to abuse of the marriage clause, they have made these changes.

i don't think this will work first of all you have to get divorce from your first husband, you are here because of your first marriage and since you are in u s on conditional status, they will deport you if you don't have anything to prove,second marriage is not going to help they make you go through the same process over again and it will be even tougher because your first marriage failed, now they will look at you like you are marrying just to be in u s. i wouldn't even recommend attorney because they take you money and INS will deny your case!

If your boyfriend marries you you are automatically allowed to stay here permanently. You can still apply for U.S. citizenship if you want, but you don't need to in order to stay.
