If you are in no major rush then your best bet is to shop around and check some of the bike magazines as they will often have reasonable quality hardtails for under this price brand new!! If you check out evans cycles on the web they have a huge range but then you are still best to either go to one of their stores or a competitor and try b4 u buy. If you go new then you may have to compromise on the brakes and go for either front disc only or lower quality disc brakes however if your budget would stretch slightly i would reccommend a Claud Butler Cape Wrath Disc coming in around £500 however may be cheaper in certain shops or found on the web( buy direct from Falcon Cycles). If buying second hand then unless you know what to look for never buy on ebay/from individuals as there is a high chance you will be ripped off. This is not the case with everyone but unfortunately some individuals spoil it 4 everyone. Go through a trusted second hand bike shop (or many bike shops can source or have a small range of second hand bikes) Unfortunately this will take petiance as you cannot order a bike in a different size second hand so need to shop around. I would reccommend a good look at your brand new options as in the long run if you make the right choice you will save as second hand bikes will have a lot more problems a lot quicker than new ones. ooooooooooo...disk brakes for under $400???? dont know about that but lots of good manufacturers make good stuff for around that. Trek - everyone and their grandma ownes one of these, good and affordable but ordinary. Specialized - again everyone's got one but they really are top of the line, even the bottome line ones. disk brakes usually come on higher end bikes though, or you could just put em on yourself, a good set will run you around $200+ though - at least for hydrolic, mechanical should be cheaper.
