Not worth appealing. The cop can argue you had another choice..that of backing off. Speed limits are there for a reason, mainly safety. And that's the maximum under ideal conditions. If the car was in front of you, how did it nearly hit you twice anyway..unless you had already attempted to pass in a dangerous situation?

If it's local then I would go to traffic court and see what happens. If you have a good record and the judge is in a good mood, who knows what will happen. I had a similar thing happen to me while I was out of town and If it had been local I would have appealed it, but being out of town several hundred miles I just payed it. Good luck.

No. If someone is driving erratically, the worst thing you can do is pass. At least that's what the judge will say. When that happens to me, I use my cell phone, call 911 and report a drunk driver, give them the plate numbers, model and description and direction of the road their traveling.

Sorry, but tough luck. If the police knew you were trying to overtake another car you could be charged with "racing". They will never listen to your excuse. Their answer will be "you should have pulled over and called the police to handle it".
