I was arrested/fingerprinted/ photographed/did a overnight in jail. First I was charged with a felony and the New York DA changed it to a Class A Misdemeanor-3rd Degree Assault. I have not been convicted waiting trial to fight the case. It was a bar fight. Now I am applying to major corporations will I be charged as guilty by potential employees before the trial if the arrest record shows and they will not hire me. In the American court system you are innocent until proven guilty. I am also being sued by the person will that show up as well in the background checks. I am more worried about my arrest record on a pending case for a misdemeanor.

Do yourself a favor (and some damage control)... Beat your prospective employers to the punch, and let them know up front what happened. Most companies will exclude you from employment for a felony conviction, but rarely for a misdemeanor. By being up front and honest, you're showing interviewers that you're a stand up person that takes responsibility for your actions. If you try to sneak it by them, they won't trust you and definitely won't hire you.

As far as the civil suit... It shouldn't show up on a police background check.

Just be honest, and I have no doubt you'll find that prospective employers will appreciate you're posessing that quality.

I believe new york is strict about this kind of situation. If you were arrested, but they never prosecuted, or found not guilty then the background screening company is not supposed to report arrests or use it in determining employment. HOWEVER, I think that an open case can be reported until it adjudicated. The company should tell you, if they see it on your records is, "once it is cleared up and there is a conclusion feel free to reapply and we can reconsider you for the position."

No, it will not show up on a routine backround (for employer check). Misdemeanors don't show up Felonies DO. If it was reduced to a misdemeanor why does it still show up as a felony. That is the only thing that warrants further investigation. Good luck with all of this dude.

Your arrest is public information, and is available to anyone.
As for a Background Check, Normally it would not appear until you are found Guilty by the Court. But, be careful when completing an application, because they ask if you have been arrested for a crime. Lie, and if they later find out, you will be fired!

If you haven't been convicted you do not need to state that in a question. Why don't you get a lawyer for a stupid offense like that. I'm sure he could get you off clean with nothing at all.

If you have not been convicted it will not show on your record yet. And you do not have to reveal it in an interview because you have only been charged not convicted.
