I just watched my 19 yr old son, in handcuffs, be arraigned for a rape that supposedly happened 2 yrs ago.. This girl is accusing him of some really unbelievably horrible things.. Things that I know my son is not capable of. After his arraignment, we finally got to read her statement and NOTHING makes sense.. Her statement is so detailed, it almost seems rehearsed and set up.. My son is no angel, but is trying very hard to straighten up his life.. He holds a full-time job and was just getting ready to get his own apt.
To top it off, this stuff supposedly happened in his bdrm in our home..?? Problem is.. we didn't even live there at the time and he has never actually had his own bdrm where we live.. When we moved in there, he was living with his girlfriend and has only recently, since their breakup, been sleeping in our guest room..
Can anyone even imagine, why now???

There are many valid reasons why rape goes either unreported or there's lengthy delay in reporting it. I won't even attempt to go into it, because I know as his mother it's not what you want to know or hear.

But the research is there for you to do. There are national women's organizations that post an abundance of information on the internet about sex crimes, the psychology of the victim and abusers, and more. But (and I don't really mean to be antagonistic) loved ones of those accused of serious crime tend not to want to believe their son or husband could do it and that it must be a flawed case. There is no amount of evidence, nothing at all, even DNA and 10 witnesses, that would ever change the mind of the loved one in the perception of guilt for their family member.

And then again....He may truly be innocent of all that he's accused of and that the case will resolve that way. That happens too. False reports and bad cases are also a fact of live and happens too often in our society.

A lot of people don't come forward when it happens, but there could be a number of circumstances as to why it's just coming up now. If there's no DNA and she didn't have a rape kit done immediately after the act, then physical evidence may not be submitted. If you have proof that you did not live at your current residence at the time, then have that handy. Consult with an attorney as soon as possible and get to work on helping your son.

There are lots of reasons why rape victims wait long periods of time before reporting it...

fear of ridicule for letting it happen...

thinking that it was not that "serious" at first.. and mistakenly thinking that they will be able to deal with it and forget it (usually just builds up and up and does not go away)...

financial reasons... perhaps they are now seeking help but cannot afford it unless they file charges against the person... and then the state may provide some assistance.

Currently our law system definatly slants in favor of the accuser, which is unusual. But there are reasons for it. Studies off rape victumes show huge emotional tramma and shock. It is not unusual for victums to hide the fact of their rape untill long after the fact, out of shame. Also haveing a rehearsed story dose not make it fake, it just means its really hard to tell the public that she was assualted. Your son should not be convicted without real evidence beyond her story (DNA).

Girls do this from time to time because their parents have found out they've had sex but they don't want to be in trouble.

The burden of proof is on her. Unless she has physical samples that link your son to this, I would just scrounge up the proof needed to exonerate your son. The fact that you didn't even live in that house at the time of the supposed rape, should be enough to get him cleared.

I'd file a suit against her for defamation of character once he's cleared. Make sure once he's exonerated that she's charged with making a false police report.

i feel for you and your son had some Friend in the same boat, did she recently file for welfare and was turned down and she cried wolf wow i was raped 2 yrs ago found out about the victims compensation she will be afforded (big bucks ) or sympathy trip, no disrespect to actual victims of rape. to me its not flying very well to wait 2 yrs in not under any threats revenge ??spare no money on a good attorney its a lifetime stigma for your son convicted ot found innocent

Problem is with raped victims, if they dont report it after the rape, they seem to keep it bottled up till they can reveil it whenever that maybe.
Anyhow, they still have to prove that your son did the crime and by the sound of things, doesnt seem like he did it but who knows, only he does.

There is clearly need for solid evidence, such as DNA, seen the fact that the events supposed to have taken place two years ago.

Stay strong, It has been two year there is no evidence (DNA). So it is her word against his. And if you can prove he did not live there 2 years ago. There should be no problem. Maybe he and she should take a lie detector test. Good luck.

Wasted such a long time, it was better to marry instead of crying and leting others know of the rape.
