The Miranda one that was mentioned in the first answer is the court case that guarantees that people being arrested get read their rights before being questioned.
However the Right to Remain Silent is guaranteed in the 5th Amendment, hence the term "Pleading the Fifth"

You are only read your rights if you are charged, and the arresting police department wants to actualy question you. You can be arrested, and not charged! Hmmmm now theres a surprise for ya aye? Ofcourse you'll be eventualy lket go if your not charged, but you can be arrested!
