I am trying to decide what to do.
My husband and I got into a fight that turned physical a year ago. He threw me around and threatened to throw me off the balcony it was a bad situation. he had me over his shoulder and I was kicking and bit his back while i was trying to get away.
I eventually got away and was able to get out of the apartment. I left for about an hour, when i came back to pick up some stuff so I could leave for my parents I was arrested for assault on my husband. He had called the cops on me saying I had beaten him up. I spent 3 days in jail and never gave a statement. my court date is up in a few weeks and I don't know if i should take the crowns plea or fight the case. they are offering me a conditional discharge with 2 years probation.
I don't feel right pleading guilty. Yet I also don't trust the legal system, the police, lawyers, anything at this point. Supposidly the police took photos of his back where I had bitten him.They didnt take any photos of my injuries.

I am not still with him i havent seen or talked to him since that day.
I couldnt file charges the police wouldnt listen to my side of the story at all.
My husband didnt file the charges either it was the crown.
I have a lawyer unfortunatly he doesnt seem to be of much use to me. i still havent seen what they are accusing me of. I was supposed to get a disclosure ages ago but still havent seen it.

Where was your lawyer in all this? Where was the domestic violence advocate in all this? Why did you leave without giving a statement? Why did you leave the station without filing charges?
Don't plead guilty if you were defending yourself, go find yourself at the very least a public defender AND start talking to the domestic violence advocates in your area, since you are not the first person to fall for that ploy. There is nothing you can do about your mistrust for the legal system at this stage since you already let yourself get cornered.

You are right to be untrusting of the legal system.. Unfortunately all the evidence is against you..but you know, I would agree with you if it were me... I would find it hard to plead quilty to something that I didn't do.. You need to at the very least talk to a lawyer or legal representative.. Do not try to do this on your own..or the justice system WILL consume you..

You can state your side of the case and hope for the best but you should have filed charges immediately after the incident. Now it may seem as you are just defending your actions with lies. Good luck to you. Hope everything turns out.

I would definitely consult a criminal defense lawyer at this point.
There's no reason why you should settle. You need to argue that the case was not handled properly by the police if they didn't follow protocol in taking proper documentation of your injuries, and nail him for perjury once court starts.

i'm no longer affirming that hitting someone is an ok reaction to call-calling, yet are you confident your son did not call this lady a attractiveness? What did the three witnesses say? No, i don't think of you should press attack expenditures. You took it to the college, they investigated the remember and issued a punishment. depart it on my own for now. do not push your son with the help of the ringer because you opt to coach the moms and dads of this 12 year previous lady a lesson.

I would fight this case. Get a good Lawyer. Tell the Judge the whole truth, that is was mutual combat, and that he is responsible for you defending yourself. See what happens. Its better than pleading GUITLY.

Did you then file a restraining order after this altercation or stay with him?
What is the nature of your relationship with him at this point?
I would call legal aid services and get some advice.

The only thing I can think of is to point out to the court that the bite mark is upside-down and the only way it could have been made is if he had you immobilized over his shoulder. File charges...he opened this can of worms...let him fish with them.
