Maybe I misunderstand your Q. If Mr Flaw is the "Plaintiff" (the person bringing the case to a court) --- What is he asking for? The "Defendant" (who would be answering to the court) wouldn't be doing the charging.

If you just have the plaintiff/defendant terms mixed up the answer would be B
