That depends on what your custody paperwork says. If it's not defined, then the custodial parent can take the child wherever they choose as long as they honor the non custodial parents visitation rights. However; if the non custodial parent has issues with the custodial parent moving away, and the custody paperwork doesn't address the issue; it would have to go to family court and a judge would have to rule.

In most cases as long as the father does not have a problem with you can move as far away as you like. Court paper may need to drawn up to make sure that neither party can come back and say they did not know they couldn't move or the father saying he did not want them to move or he did not know about it.

A judge mostly likely can not say you can not move if the father is ok with it.

my father was paying child suppoert for 14 yrs. and didnt see us once. my mother moved to florida right after court. My father lives in NY. but when i was 14 i finally visited. so to answer ur question im not 100% sure but i think the mother if she has solo custody she can go where ever she wants. my sis is going through a nasty custody battle and she has living rights at the moment but the father of her kids didnt do what the court asked so now they told her if she back goes to court for solo custody they will give it to her and she can go where ever she wants and there is nothing her can do about it. But if u still have parental rights i dont think she can go to far. good luck

Unless it is in paper that she can't move out of the state then she can't but if not then she can move anywhere with in the state. You'll just have to come up with meeting in the middle. Or you can take her back to court if she is moving out of state and revise the visitation order. If she live's with in the states it's still good to go and revise the visitation just so you both have to go the same distance. I know it is this way in WA but other states I am not sure on how they work. If paying child support call your case worker to see if they can give you any info or numbers to call. Or you can look it up on the Internet for your state. Just go to your local court page and they should have a site or numbers to people to contact.

Ordinarily, if there is child support in place, then there is visitation or a parenting plan in place. Legally, she would have to get a Judge's order or consent to move out of state with the child. Make sure that you know what rights you have, stated in the parenting plan. Make sure that the court knows that you want to be able to have parenting time, and you feel that she is going to deny you that time due to geographic location.

If she is the custodial parent she can move where ever and how far she wants and still collects child support from you. Now if you want them in the same state you have to go back to court and fight for it.

If she has sole custody she can move as far away from you as she wants and it doesn't effect your having to pay child support. It's still your kid no matter where they live..

Depends what your papers say. If the papers don't state it, then you need to consult state law. Many are "cannot move outside the courts jurisdiction without a modification of the papers". This could mean city, county, state, etc.
