VA Employer said they didn't have to turn anything in until Jan. and IRS says employee has nothing to do with anything that an employer does..but what happens if at the end of the year, the employer doesn't provide w-2s and is keeping all this withholding tax they are taking each wk (over $100).

Are you sure they're not turning in the money, which is definitely not legal, or is it just that they told you they have until January to give you a W-2, which is correct.

The IRS says the employee is not PENALIZED BY THEM for what the employer does, but they should be real interested in this info of what the employer is doing. The employer is required to pay the withholding to the government at least monthly, is NOT allowed to keep until January. They have to give you a W-2 by the end of January.

If you have good reason to believe they aren't depositing the money as required, and have called the IRS about this and they have ignored you, call 1-877-777-4778 and ask to talk to a taxpayer advocate and explain the situation.

That's illegal. They are stealing. Even a self-employed individual is required to submit quarterly taxes so the IRS gets the money earlier. If you're sure they're not sending in the withheld money, then report them to the IRS. But how could you know for sure?

I don't buy that! The IRS, is always interested in an employee's income!! Are you sure he is not turning all the taxes to IRS? Remember sone goes to unemployment, and State taxes!

If they are doing this it is illegal and you should turn them in or quit. By law they must pay the state department of revenue all sales tax. The IRS will come after them for their portion of taxes. Call the IRS pronto.

They are required by law to provide W-2's by January 31 or they are in violation of Federal Law. I'd ask another IRS person.
