My fiance decided he wants to wait until December to get married. He's a full time student so I know I can claim him as a dependent, but can I claim him in 2007 on my income taxes if we don't get married until December?

Congratualations on your upcoming wedding!

A December 2006 wedding sounds goods because:

1) You CANNOT claim your finance as a dependent, even though he is a full time student, because his is not your qualifying child or qualifying relative (IRS publication 501, Table 5) and

(2) A spouse is never considered your dependent for tax purposes, but you will both be entitled personal exemptions on a joint return (IRS Publication 501, page 9 under Spouse's Exemption).

If you're married by Dec 31, the IRS considers you married for the entire year. (Same goes when you have kids, by the way). So, rather than claiming the smaller Single or Head of Household deduction, you'll be eligible to file a Married (Joint) or a Married (Seperate) return. Even if he has no income, you can still file jointly to avoid a reduction in allowable deductions and credits.

Since you mentioned he is a student, I would also caution you not to miss out on available education credits and adjustments. even if he accrued them before you were married, it counts in this case.

If you get married by December 31st, you can file Married filing jointly and claim yourself and your husband on your 2006 tax return that you file by April 15, 2007.

You can claim him on the taxes the year you get married.
