As the law is (In on Monday) Children under 12 that are less than 4 foot 5 inches which is equal to 135 centimetres must have a booster seat except in an emergency (IE you need to get your child to an hospital casualty dept.). You must provide this seat even if you are carrying other people's kids say like on a school run.
TAXI cabs (Must have a Hackney carriage licence affixed to the back of the taxi) are exempt from this EU Directive.

Since this law was introduced it has been found that ADULTS of less than the required height may have to have a booster seat because of the wording of the current law. This issue was debated on Radio 2 with the said minister and he said that any adult also under the height limit would need a booster seat.

It is time to get out the tape measures or cut a stick 4 ft 5 inches long.

So to answer you question about your child, I am afraid that you will have to measure your child as there is an on the spot fine of £30.00 for the driver of the car/vehicle caught without such a seat in place for a child less than this height. If your child is above the height then no worries you do not need a seat. If your child is below the height then a booster seat is needed until s/he reaches that height.

I have a high back car seat with a 5-point harness and has seat belt adjusters on the side for when she is older and doesn't need the harness, she is 4 years old and only weighs 34lbs but she is 43 inches tall. the smaller booster would be fine for your mums car if he isn't in it all the time. Either on is fine, the seat helps keep the lap belt at the proper height on his little body so in case of an accident he doesn't suffer internal injuries or dislocation of the hips.

This new child seat law has been confusing for many.

I know that places like Argos are selling booster seats for children from 3 years + .

But really a child that young should still be in a proper child seat especially as an adult seat belt would cut into the child's neck. Also booster seats can still move around on the car's seat and I don't think your son's weight would keep it in place.

I think they are both ok to use my son has a boster seat with a back im my car and just a plain booster seat in his dads. The advice i can give you is try to get a seat with kind of side handles for the seatbelt to go under to stop it hurtinh his neck.

Now entering its fifth year, NHTSA's Ease of Use Ratings program strives to prompt child restraint system (CRS) manufacturers to improve their products and make them easier for consumers to use.
The purpose of the ratings program is to educate parents and caregivers about child safety seat features and to assist them in finding the appropriate child safety for their needs.
The majority of models rated for the first time during this testing season were awarded “A” ratings. This demonstrates that manufacturers are being particularly mindful of Ease of Use criteria as they are introducing new systems as well as continuing to improve upon previous designs.
Among the 2006 findings:

There were 99 different CRS selected from fourteen different manufacturers. Including the multiple modes from convertible and combination seats, there were 160 total ratings. This is a slight increase from 2005, where 92 CRS were selected with a total of 144 ratings.
In order for a seat to qualify as an overall “A”, it must receive an “A” rating in every possible mode. Out of the 99 CRS rated in 2006, 85 received an “A” for all of their modes, 9 received a “B” for all of their modes, and 5 had mixed scores of “A” and “B” among their different modes. The percentage of overall “A” ratings awarded increased almost 5% from 2005.
As in 2005, there were no child restraints that received an overall “C” rating. There were still several “C” scores within the categories, but the percentage of “C” scores was nearly the same as in 2005.
Three seats that were rated in previous years improved their overall scores from a “B” to an “A”. These seats were the Triple Play Sit ‘N Stroll (formerly manufactured by Safeline), Evenflo Big Kid (HB), and Evenflo Discovery.
A number of redesigned seats that were re-rated maintained their “A” ratings. In most cases, improvements were seen within categories that they had formerly been assigned “B” or “C” ratings in. These seats were the Cosco Alpha Omega 5pt, Evenflo Big Kid (No Back), Evenflo Embrace, Evenflo Discovery, Graco Comfort Sport, and Safety 1st Surveyor

Call your local police dept, ask them to come to your house and answer your question. Most police depts give free seminars on safety seat installation. More people install their seats incorrectly than those who use the wrong type of seat for the age.

No, a booster seat is not ok for younger kids under 3. Its important that it is a car seat that buckles the baby and then buckles into your car. Booster seats just have one buckle-theone already in the car.
