I am not sure what you are talking about when you say "open" prisons. I am not sure what state or country you are in.
However, here in the southern part of the US, inmates are classified prior to placement in a prison. Their classification will determine if they will be sent to a maximum, medium, or minimum security prison. This classification is determined by previous criminal history as well as their current charge and by their behavior in the facility where they stay until they are classified.
The classification system is based primarily on violent behavior. If the person is violent, has a history of assaulting officers or other inmates, violates the rules of the holding facility, or has attempted escape, then the person is considered to have a high risk assessment.
Typically, rapists or other violent sex offenders will go to max or med security prisons. However, if the offender was not violent in the assault, (such as child molesters, date rape, etc) then they are a lower risk for causing problems or attempting escape. These offenders often go to minimum security prisons. A lot of these offenders seem to be nice (that's how they get their victims to trust them) and they often become "trustees" where they are allowed more freedoms than other prisoners.
The classification depends more on violent behavior and escape risk than just seriousness of the crime.

Firstly the government doesn't put anyone in prison the judiciary do that.
Sex crime perpetrators are generally kept in closed prisons, on occasion they get decategorised down to open prisons, but ultimately the majority are released back into society anyway. A sex offender in an open prison is in a precarious position, after all there is no Rule 43 in open prison, so they risk a great deal with their personal safety.
A previous respondent stated that it was because drug offenders were in custody that sex offenders were in open prisons. I think they used the term victimless crime in the same sentence as a drugs offence. I have yet to see after 20 years working in the justice system a victimless crime.
Its a sad indictment of our times that crime is generally on the increase, but sexual offenders are a small part of the overall trend. If a sexual predator is a risk, they are kept in the category of prison most suitable for them sadly it is only possible to keep them their for the term of their sentence.
Perhaps it would be more appropriate to look at our sentencing guidelines particularly for those who are prolific and predatory amongst all types of crime and make society safer that way.

Hi Shane. Didn't see your question first time round so I hope I'm not taking you the wrong way too but basically I was unaware that the government WERE putting sex offenders into open prisons. Usually they go into medium or maximum security prisons. I suppose it's possible those nearing the end of their sentence could be put into open prison to help with their release but that seems unlikely too.
So the simple answer for me is simply I really don't know as I was unaware that they did.
Do you have any examples or references please?

Sex offenders should never be allowed in an "open" prison. I think stuff their human rights (what about the people who they abused) they should all be used instead of using animals to test products on. You should give up your human rights when you breach another persons! It is not a deterant is it? Be a good boy/girl in prison where you get lovely food, tv etc and you'll be out in 5 mins! For the people who have been abused they have to serve a lifetime!!

Britain's punishment is terrible that's why the future of our children doesn't look bright more and more people know that its a soft country and will take the piss where-*** in Egypt if you steal you get your hand chopped off here they buy you a bag of sweets and say well done the system is crap and they have no idea of behaviour problems and every one has a right in some way like if i were to smack my child i could have that child taken away from me but punishment is needed to stay in line its all wrong and needs a slap on the **** to sort things out before long no one will give a crap about the law and then we,ll have riots watch this space ..........

as to why some dont who knows...

There is no such thing as OPEN PRISONS, as all prisons have their security systems. What I understand from your question is why are these offenders not put behind bars. Probably the courts did not convict them of the offenses they are accused of.

Your question is flawed in that 'they' do not put convicted sex offenders in open prisons.
They do, however, put some people on the SO Register in them.
There are all sorts of people put on the SO Register. They range from serial rapists attacking babies to boys(& girls) who go 'too far' with their girlfiends (boyfriends). We know of a 16 y.o. boy who is on the SO Register for playing with his girlfriends boobs (she was 15 at the time I think); her parents caught him & complained to the Police. He was cautioned & is now on the SO Register. Legally he is a 'sex offender', but did he do anything more than that which my generation called heavy petting?

because some English law is as screwed up as American, i don't know why they do it but i agree that they should be put in maximum security, my work is next to an open prison and they have murderers there and all sorts, yet i see them wandering around like they are free!
