it is legal as long as you don't get more than face value for them. That is the definition of 'scalping'.
So if the ticket says $35 on it, you can sell them for that or less.
OR
You can start a business in some places, like New York, called a ticket 'brokerage'. And as long as you are in an office selling those tickets, you can get whatever price you want. But if you do it on the street, its 'scalping'.

In most sports, you can do that as long as you meet the two criteria:
1. Sell them at face value (what you paid for them)
2. You can't do it on stadium property. You must be off their property, then it is legal. If you are on their property, then they will arrest you for scalping - even if you are selling them at face value.

Don't sell it on the Stadium Grounds... or you could potentially be arrested as a "scalper." but if you're selling for the price you paid ther should be little difficulty. If you're looking to make a "killing," then best practice your body language to attract would -be "takers" and not "undercover enforcers."

I know of people who sold tickets when they had extra's. Go for it, just don't be too obvious about it.

you can sell them at face value only and be legal. otherwise it is scalping which is illegal.
however if you sell them to a private individual for cash and you KNOW this person, no one will be the wiser.
