"...and before I knew it that tree came out of nowhere". I have actually heard this one from an insured. Now, for the crown jewel of all dumd-@ssed reasons why the accident wasn't 'my fault': an engineer (who else) actually told me to my face that since everything in the known universe on a molecular level was not static but in constant motion he could not have hit the other car from behind as it sat, waiting to turn left; he felt they actually hit EACH OTHER, so therefore, his insurance should not be responsible for the other party. My response was, " quantum mechanics aside, in Alabama your car struck the other from behind...".
I cannot make this kind of crap up, folks.

"Extremely strong winds overrode the parking brake, causing the truck to roll down the street." (This truck was actually a tractor-trailer combo - about 99,000 pounds. Amazingly, there was no wind damage to any of the buildings).

It was a dog. Had to slam on my brakes. The guy tailgating me crashed into my rear end. guess HE didn't see the dog.
